These Terms of Service ("Terms") govern your access to and use of the websites and products operated by MJ Labs LLC ("MJ Labs," "we," "us," or "our"), including mj-labs.dev and all associated product pages and services.

By accessing or using our website or products, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. About MJ Labs

MJ Labs LLC is a software company incorporated in Washington State. We build and operate software products including Butler (hospitality software), myCasa (home management), and Financial Fortress (personal finance). Products currently in development are subject to separate terms upon launch.

2. Use of Our Website and Services

Permitted use

You may use our website and services for lawful purposes only. You agree not to:

• Use our services in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of our systems
• Transmit harmful, offensive, or disruptive content through our contact forms or any other channel
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use automated tools to scrape, crawl, or extract data from our website without prior written permission

Minimum age

Our services are intended for users 18 years of age or older. By using our services, you represent that you are at least 18 years old.

Account access

Certain products may require account creation. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@mj-labs.dev if you suspect unauthorized access.

3. Intellectual Property

All content on our website and within our products — including but not limited to text, graphics, logos, product names, software, and design — is the property of MJ Labs LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any MJ Labs content without our prior written consent, including consent provided by email.

4. Products and Pricing

Demo requests and inquiries

Submitting a demo request or inquiry through our website does not constitute a binding agreement or commitment on either party. Any engagement for paid products will be governed by a separate agreement.

Pricing

Product pricing is subject to change. We will provide reasonable notice of pricing changes to existing customers. Continued use of a product after a pricing change constitutes acceptance of the new pricing.

Subscriptions and billing

Where applicable, product subscriptions are billed annually in advance. Billing cadence and refund terms will be specified in the product-specific agreement for each service.

5. Third-Party Services

Our products and website may integrate with or link to third-party services (including Twilio, AWS SES, Stripe, and Supabase). Your use of those services is governed by their respective terms and privacy policies. MJ Labs is not responsible for the practices or content of third-party services.

Where Butler is deployed at a resort property, the resort operator is responsible for obtaining any required guest consent for SMS and WhatsApp communications under applicable law. Guest communications are governed by the separate B2B agreement between MJ Labs and the resort operator.

6. Disclaimer of Warranties

Our website and products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, error-free, or free of harmful components
• Warranties regarding the accuracy or completeness of any content

7. Limitation of Liability

To the fullest extent permitted by applicable law, MJ Labs LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the fees paid to MJ Labs for the specific product giving rise to the claim in the twelve months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless MJ Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:

• Your use of our website or products
• Your violation of these Terms
• Your violation of any third-party rights

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use our services ceases immediately. We may retain your data as required by law or as described in our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles.

Any dispute arising out of or related to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in King County, Washington, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Each party waives any right to bring claims as a plaintiff or class member in any class action, class arbitration, or representative proceeding. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

12. Force Majeure

MJ Labs shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, power outages, internet failures, acts of government, or other events outside our reasonable control.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any product-specific agreements, constitute the entire agreement between you and MJ Labs LLC regarding your use of our services.
